This essay deals with property rights in body parts that can be exchanged in a market. The inquiry arises in the following context. With some exceptions, the laws of many countries permit only the donation, not the sale, of body parts. Yet for some years there has existed a shortage of body parts for transplantation and other medical uses. It might then appear that if more sales were legally permitted, the supply of body parts would increase, because people would have (...) more incentive to sell than they currently have to donate. To allow sales is to recognize property rights in body parts. To allow sales, however, makes body parts into “commodities”—that is, things that can be bought and sold in a market. And some view it as morally objectionable to treat body parts as commodities. (shrink)

Averroes on Intellect provides a detailed analysis of the Muslim philosopher Averroes 's notorious unicity thesis -- the view that there is only one separate and eternal intellect for all human beings. It focuses directly on Averroes' arguments, both from the text of Aristotle's De Anima and, more importantly, his own philosophical arguments in the Long Commentary on the De Anima. Stephen Ogden defends Averroes' interpretation of De Anima using a combination of Greek, Arabic, Latin, and contemporary sources. Yet, (...) Ogden also insists that Averroes is not merely a 'commentator' but an incisive philosopher in his own right. The author thus reconstructs and analyzes Averroes' two most significant independent philosophical arguments, the Determinate Particular Argument and the Unity Argument. Alternative ancient and medieval views are also considered throughout, especially from two important foils before and after Averroes, namely, Avicenna and Thomas Aquinas. Aquinas' most famous and penetrating arguments against the unicity thesis are also addressed. Finally, Ogden considers Averroes' own objections to broader metaphysical views of the soul like Avicenna's and Aquinas', which agree with him on several key points including the immateriality of the intellect and the individuation of human souls by matter, while still diverging on the number and substantial nature of the intellect. The central goal of this book is to provide readers with a single study of Averroes' most pivotal arguments on intellect, consolidating and building on recent scholarship and offering a comprehensive case for his unicity thesis in the wider context of Aristotelian epistemology and metaphysics. In this foundational work on the theory of linguistic and mental representation, Stephen Schiffer surveys all the leading theories of meaning and content in the philosophy of language and finds them lacking. He concludes that there can be no correct, positive philosophical theory or linguistic or mental representation and, accordingly advocates the deflationary "no-theory theory of meaning and content." Along the way he takes up functionalism, the nature of propositions and their suitability as contents, the language of thought and (...) other sententialist theories of belief, intention based semantics, and related issues in ontology. I defend the claim that understanding is the goal of explanation against various persistent criticisms, especially the criticism that understanding is not truth-connected in the appropriate way, and hence is a merely psychological state. Part of the reason why understanding has been dismissed as the goal of explanation, I suggest, is because the psychological dimension of the goal of explanation has itself been almost entirely neglected. In turn, the psychological dimension of understanding—the Aha! experience, the sense that a certain explanation (...) “feels right”, and so on—has been conspicuously overemphasized. I try to correct for both of these exaggerations. Just as the goal of explanation includes a richer psychological—including phenomenological—dimension than is generally acknowledged, so too understanding has a stronger truth connection than is generally acknowledged.Keywords: Understanding; Explanation; Philosophy of science; Epistemology. This article offers some general criticisms of the idea that any political theory can legitimate public health interventions, and then some particular criticisms of Civic Republicanism as a political theory for public health. Civic Republicanism, I argue, legitimizes liberty-infringing public health interventions by demanding high levels of civic engagement in framing and reviewing them; to demand such engagement in pursuit of such a baseline value as health will leave insufficient civic energy for the pursuit of higher values.

In this chapter, Immanuel Kant explains the crucial role played by biblical scholars: true religion must be universal, yet the dogmas that define a historical faith are not naturally universal. He attempts to defend the role of biblical scholars as both necessary and legitimate. Kant then turns to an analysis of why biblical theologians nevertheless tend to have a negative effect on church life and why the traditional linkage between Christianity and Judaism only exacerbates this problem. He relates both the (...) “convoy” metaphor and his redefinition of faith, as grounded in one of two possible principles, to his earlier distinction between true service and pseudoservice. Kant also explores different aspects of how churches tend to be unsuccessful in such efforts and how such failures can be avoided. The chapter concludes with comments on a more affirmative topic, where Kant conveys a principle to assist visible churches in avoiding religious delusion. (shrink)

A description and analysis of attitudes to non-human animals in classical and late antique Mediterranean thought.

This is the third in a series of articles that correlates Kant's architectonic with the Yijing's sixty-four hexagrams. Previous articles explained “architectonic” reasoning, introduced four levels of the “Compound Yijing,” consisting of 0 + 4 + 12 + gua, and suggested correlating the fourth level's four sets of twelve to the four “faculties” in Kant's model of the university. This third paper examines the philosophy faculty, assessing whether the twelve proposed gua meaningfully correlate with twelve basic philosophical concepts that Kant (...) introduces in his three Critiques. A key difference emerges: Kant's architectonic method aims to produce synthetic a priori knowledge, while the Yijing's architectonic method aims to produce analytic a posteriori belief. (shrink)

Three states—Oregon, Washington, and Vermont—have used straightforwardly democratic means to legalize the practice formerly known as “physician‐assisted suicide” but now termed “aid‐in‐dying.” In two states—Montana and New Mexico—aid‐in‐dying has been declared legal neither by directly democratic action by citizens nor by representatively democratic action by the legislature but by court rulings in cases brought by aid‐in‐dying activists. The court case in New Mexico (Morris v. New Mexico, 2014) is undoubtedly of greater significance to the rest of the states. For the past few years I've had the distinct privilege to edit the Hastings Center Report's Policy & Politics column. The column—as indicated by a little block of text at its end—was originally conceived as, and remains, a joint production of HCR and the American Society for Bioethics and Humanities. For me, as column editor, this means that I can accept contributions only from ASBH members. Luckily this presents me with an extremely large pool of talent from which to draw! (...) I am very proud of the fact that a large majority of contributors to the column in the last several years had never written in HCR before I invited them to contribute. The United Kingdom's coalition government has just begun the most sweeping overhaul of the National Health Service since its inception.1 Under the reforms, 80 percent of the NHS budget will be handed over to about five hundred local consortia of primary care physicians, who will be empowered to make medical spending and allocation decisions for their patients. Early in 2018, the Trump administration's Centers for Medicare and Medicaid Services issued a guidance letter outlining a new and controversial kind of Medicaid waiver proposal. The administration invited states to propose waivers that would impose work (or other “community engagement”) requirements as a condition of eligibility for Medicaid. The Trump administration and state proponents of work requirements want to force able‐bodied Medicaid beneficiaries into the workplace. Critics allege that this is because they mistakenly believe that low‐income individuals are not (...) working because they're lazy or because aid programs provide them with a disincentive to work. Proponents respond that the requirements can lower the public programs' costs while helping its recipients. Medicaid data seems to show that the work‐requirement proposals are a solution in search of a real‐life problem. (shrink)

The Bishop of Questoriana has recently asked for a pontifical document ‘furnishing a doctrinal foundation of love and respect for life existing on the earth’. Mainstream moralists have urged, since the Axial Era, that it is human life that most demands love and respect. We realize and perfect our own humanity by recognizing humanity in every other, of whatever creed or race. Realizing that biological species are not natural kinds, more recent moralists have hoped to found moral decency either on (...) a respect for ‘rationality’ which excludes many of our conspecifics, or on simple loyalty to our immediate kin. Neither option is without its costs, and Catholic moralists in particular have often been suspicious of a morality that seems to lead to contempt for ordinary human life. Neither advocacy of ‘animal rights’ nor utilitarian calculation of animal pains and pleasures sit well with a traditional Catholic morality. Conversely, many of those who defend traditional practices such as hunting, farming or goading animals to fight, themselves suppose that ‘human’ and ‘animals’ may sometimes inhabit the same moral universe, that there are virtues that both may display in ‘noble action’. Developing this thought, it is possible to locate decency elsewhere than in an over-intellectual respect for ‘reason’. Decent treatment of animals (as of others) is that form of life which lets us live together ‘humanely’, in appreciation of the actual beings they are. Virtue, as Aristotle argued, lies less in acting nobly than in appreciating nobility. Those who claim to appreciate such nobility in beasts must learn to live humanely. (shrink)

The United Kingdom is partway through a multiyear process of revising its law on surrogacy, both traditional and gestational. In October of 2019, the Law Commission of England and Wales and the Scottish Law Commission—statutorily created independent bodies charged with keeping the law under review and recommending reforms whenever necessary—completed a public consultation on surrogacy. In June, the commissions published an extensive consultation paper laying out the case for surrogacy reform and making tentative recommendations about how revision should proceed. The (...) commissions are now digesting the public's responses, and they aim to have a final report on their proposed revisions of the law and a draft bill for consideration by Parliament in 2021. The foundation of current U.K. surrogacy law was laid in the Surrogacy Arrangements Act of 1985. There are numerous problems with the existing regime. (shrink)

Object files (OFs) are hypothesized mid-level representations which mediate our conscious perception of persisting objects—e.g. telling us ‘which went where’. Despite the appeal of the OF framework, not previous research has directly explored whether OFs do indeed correspond to conscious percepts. Here we present at least one case wherein conscious percepts of ‘which went where’ in dynamic ambiguous displays diverge from the analogous correspondence computed by the OF system. Observers viewed a ‘bouncing/streaming’ display in which two identical objects moved such (...) that they could have either bounced off or streamed past each other. We measured two dependent variables: (1) an explicit report of perceived bouncing or streaming; and (2) an implicit ‘object-specific preview benefit’ (OSPB), wherein a ‘preview’ of information on a specific object speeds the recognition of that information at a later point when it appears again on the same object (compared to when it reappears on a different object), beyond display-wide priming. When the displays were manipulated such that observers had a strong bias to perceive streaming (on over 95% of the trials), there was nevertheless a strong OSPB in the opposite direction—such that the object files appeared to have ‘bounced’ even though the percept ‘streamed’. Given that OSPBs have been taken as a hallmark of the operation of object files, the five experiments reported here suggest that in at least some specialized (and perhaps ecologically invalid) cases, conscious percepts of ‘which went where’ in dynamic ambiguous displays can diverge from the mapping computed by the object-file system. When composing “Echoes” I set out to express in an artistic form the cognitive dissonance we sometimes feel between the depth of divine Presence in our experience and the often perplexing shallowness of the various “presences” we experience in our daily life. By starting out with a reference to “every time” and “every space”, the first stanza highlights the contrast between these mundane presences and what religious believers might call “God’s Voice”. If the poem has a “primary” message, it is (...) that God is in all these perplexing presences, though not always (or ever?) in a way that enables us to explain or fully comprehend that Presence with neat rational formulae. This is the second of a series of two articles examining Kant’s attitude toward mystical experiences and the relation between his interest in these and his interest in constructing a Critical System of metaphysics.“The Critical Mysticism” explores the extent to which Kant’s writings prior to his Opus Postumum (and not including [DREAMS]) contain a more developed theory of mystical experience. Traditionally Kant has been regarded as against all brands of mysticism. This arises partly from his narrow use of “mystical,” but (...) primarily from a misunderstanding by commentators of his statements concerning the possibility of supersensible experience. The latter misunderstanding can be easily corrected by clearly distinguishing between “immediate experience” and experience in Kant’s technical sense of “empirical knowledge.” Kant never denies the possibility of an immediate ex-perience of supersensible reality, but only the supposition that such experiences can establish empirical knowledge. The character of his Critical mysticism can be discerned, even without examining Kant’s Opus Postumum (which was to describe fully his Critical mysticism). For on numerous occasions he explains the two respects in which an immediate supersensible experience is not only acceptable, but supports and is supported by his Critical System. The mysteries of nature and the moral law provide the two sides of Kant’s mystical coin, both in theory and in the discipline of his own life. (shrink)

On the fourth day of his presidency, Donald Trump reinstated and greatly expanded the “Mexico City policy,” which imposes antiabortion restrictions on U.S. foreign health aid. In general, the policy has prohibited U.S. funding of any family-planning groups that use even non-U.S. funds to perform abortions; prohibited aid recipients from lobbying for liberalization of abortion laws; prohibited nongovernment organizations from creating educational materials on abortion as a family-planning method; and prohibited health workers from referring patients for legal abortions in any (...) cases other than rape, incest, or to save the life of the mother. The policy's prohibition on giving aid to any organization that performs abortions is aimed at limiting alleged indirect funding of abortions. The argument is that if U.S. money is used to fund nonabortion programs of an abortion-providing NGO, then the NGO can simply shift the money thus saved into its abortion budget. Outside the context of abortion, we do not reason this way. And the policy's remaining three prohibitions are deeply troubling. (shrink)

This is a chapter in the book titled 'Mind that Abides' published in 2009 by John Benjamins and edited by David Skrbina. It introduces a view of panpsychism as a solution to the hard problem of consciousness motivated by insights from cognitive science, neuroscience, and general systems. It contrasts with the incomplete anthropocentric NCC (neural correlates of consciousness) view that dominates in neuroscience, and suggests experimental and conceptual methods of verification.

Explanatory inquiry characteristically begins with a certain puzzlement about the world. But why do certain situations elicit our puzzlement while others leave us, in some epistemically relevant sense, cold? Moreover, what exactly is involved in the move from a state of puzzlement to a state where one’s puzzlement is satisfied? In this paper I try to make sense of these questions by focusing on two case studies, one from the popular literature on string theory and one from recent debates in (...) the philosophy of mind.
